No-Fault Insurance

Understanding "No-Fault" Insurance

What is "No-Fault" Insurance and what does it cover? New York’s No-Fault insurance law is designed to make sure insurance companies quickly pay a person’s expenses for medical treatment, lost wages, and other costs after they’ve been in a car accident regardless of who is at fault. Otherwise, payment for these expenses would be unnecessarily delayed by insurance companies disputing who was responsible for the accident and liable to pay.

New York No-Fault insurance benefits will pay a combined maximum of $50,000 to an injured person after a car accident for the following:

  • Medical expenses;
  • 80% of lost wages up to $2,000 per-month, paid over a maximum of 3 years;
  • Reasonable and other necessary expenses up to $25 per day (e.g., mileage for travel to medical appointments)

New York No-Fault insurance benefits are not necessarily automatic – you must apply for No-Fault insurance benefits with a certain time period after an accident. This is normally accomplished by submitting a completed NF-2 Application for Motor Vehicle No-Fault Benefits form to your insurance company after the accident, but can also be accomplished in several other ways.
